> NBC Agrees to Correct Improper I-864 RFEs For Proof of "Legal" Income
The National Benefit Center (NBC) has informed AILA-NBC Liaison that NBC issued a number of Requests For Evidence (RFEs) on Affidavits of Support (I-864) where the income of the Sponsored Immigrant was used to meet the family's income requirement. The RFEs stated that any income earned while not employment-authorized would not be considered on the I-864, even if that income was reported on the tax return. NBC recognizes that these RFEs were improper and would like to be notified of the cases where such an RFE was issued. If you have received an RFE of this type, please use the AILA NBC liaison inquiry system to ensure that the case is adjudicated correctly. It is also recommended that you still answer the RFE to avoid the case being automatically denied for abandonment.
